*MOTION FOR INDEPENDENT EXPERT


PEOPLE OF THE STATE OF COLORADO in the Interest of:

Minor Child, et. al, Minor Children,

and concerning Respondent Respondent, et. al.


COMES NOW Respondent, Respondent, by and through respondent’s appointed attorney, Attorney, and moves this Court grant respondent an independent expert pursuant to §19-3-607, CRS, as amended, namely Dr. Richard Spiegle, a clinical psychologist, to be paid by the state pursuant to §19-3-610, CRS, as amended. Dr. Spiegle will perform the mental condition evaluation of respondent within the guidelines of Chief Justice Directive 87-01, Amended 1/1/98. Respondent asks also Dr. Spiegle be appointed, if necessary, and paid separately to:

1. The termination motion was filed 8/20/97.

2. This motion was preliminarily granted in court on 10/32/97 pending this written motion and proposed order.

THIS COURT having read the Motion of Respondent and being fully advised in the premises therein,

ORDERS that Respondent may engage an independent expert for an evaluation cost, according to Chief Justice Directive 93-3, not to exceed $1000.00 for the mental condition evaluation of the Respondent, and not to exceed a further $1,500.00 for a child-parent evaluation, a report concerning the child-parent evaluation, and testimony at trial, if deemed necessary by Respondent’s counsel, unless further ordered by this court.
